These terms cover quotes, orders and decoration work placed with EMBRIGGS, 4235 E Wood St, Phoenix, AZ 85045. Placing an order means you accept them. If your company works to its own purchase terms, tell us before you order and we will agree in writing which apply.
Quotes are valid for 30 days unless the quote says otherwise. Prices depend on garment cost, quantity, decoration type and the number of print or stitch locations, and a change to any of those changes the price. Garment costs come from our suppliers and can move without notice, so we will re-quote rather than absorb a large change. Every price is calculated by us: a price shown on the site is the price the cart charges.
We do not begin production until you have approved your proof. The proof shows placement, size, colors and spelling, and approving it means those are what you want. Once a proof is approved, that is what gets made, and an error that was visible on an approved proof is not something we can remake at our cost.
If we send a revised proof, the earlier one is void and only the current version can be approved.
Artwork you send stays yours. By sending it you confirm you own it or have permission to use it, and you agree to cover us against any claim that decorating it infringed somebody else's rights. We will refuse work that appears to infringe a trademark or copyright.
We may show finished work in our portfolio and on social media. Tell us and we will not.
Blank goods with no decoration are paid at checkout, by card or bank transfer through Stripe. Decorated orders are invoiced once the proof is approved, and production is scheduled against payment of that invoice. Approved business accounts may be billed on agreed terms. Card details are handled entirely by Stripe and never reach us.
Arizona transaction privilege tax is added at the applicable rate unless we hold a current, valid exemption certificate for your organization.
We give a turnaround estimate with every quote, counted in business days from proof approval and payment, not from the date you enquired. If you have a fixed in-hands date, tell us before you order so we can confirm it in writing. We are not liable for delays caused by supplier stock, carrier delays, or a proof approved later than expected, although we will always tell you as soon as we know.
Risk in the goods passes to you on delivery to you or to your carrier.
Decoration is a physical process with a spoilage rate. Where an order cannot be completed exactly, we may ship up to 3% over or under the quantity ordered and bill the quantity actually shipped. If you need an exact count, tell us and we will order extra stock to guarantee it.
Screens and printed proofs do not reproduce thread and ink colors exactly, and garment dye lots vary between production runs. We match as closely as the materials allow. If exact color matching matters, ask us for a physical sample before the full run.
You can change or cancel an order at no charge up to the point we approve artwork for production or order the blank garments, whichever happens first. After that, you are responsible for the cost of work already done and stock already bought. Once decoration has begun, an order cannot be cancelled.
Custom decorated goods are made to your specification and cannot be returned or exchanged because they are no longer wanted, the wrong size was ordered, or the design is no longer needed. This does not affect your rights where goods are faulty.
If something is wrong with your order, tell us within 10 business days of delivery and keep the goods as they arrived. Where a fault is ours we will remake the affected pieces or refund them, at our option. Undecorated blank goods may be returned within 14 days if unwashed, unworn and in original packaging; a supplier restocking charge may apply.
Where we run a branded store for your organization, you are responsible for who you give access to and for the artwork you load into it. Orders placed through your store by your staff are orders placed by your organization on these terms.
Our liability for any order is limited to what you paid for that order. We are not liable for indirect or consequential loss, including lost profit, lost business, or the cost of an event going ahead without the shirts. Nothing here limits liability that cannot lawfully be limited.
Do not attempt to break, overload or gain unauthorized access to this site or to another customer's records. Product images, descriptions and specifications come from our suppliers and may be updated by them. The EMBRIGGS name, logo and site content are ours.
These terms are governed by the laws of the State of Arizona, and any dispute will be heard in the state or federal courts of Maricopa County, Arizona.
We may update these terms; the version in force is the one published here when you place your order. The date at the top shows when it last changed.
